WEFI FORFAITING AND PAYMENTS SOLUTIONS L.L.C, a limited liability company incorporated in the Dubai Department of Economy & Tourism under license no. 1605302 (“WeFi”, “we”, “our” or “us”) values your security and privacy.

It is the policy of WeFi to respect the privacy of those visiting WeFi’s website (the “Website”) and/or mobile application (the “App”). WeFi is required to comply with the UAE Federal Decree Law No. 45 of 2021 Concerning the Protection of Personal Data, as may be amended (the “DP Law”), and may, for certain types of personal data processing, also be subject to other UAE laws and regulations or laws of other jurisdictions.

This Notice applies to persons who access or use the Website (collectively “you” or “your”).The Notice sets out the basis on which WeFi processes any information, including any Personal Data (as defined below), collected from you or provided by you in connection with your use of the Website.This Notice will be binding upon you when you access the Website. By accessing and/or using the Website, you acknowledge that you have read, understood and agreed to the Notice and, where required under applicable law, consent to the processing of your Personal Data as described in it.In accordance with the DP Law, the Notice and, as applicable, WeFi’s website terms and conditions which are available at wefi.pro/terms-conditions, WeFi collects information about you when you use or access the Website, use WeFi’s email addresses for contact purposes, or you avail of other web-based products, information or services of WeFi (collectively, the “Website Services”) as well as through other interactions and communications you have with us.

In the Notice, the term “Personal Data” means any data related to a specific natural person or related to a natural person that can be identified directly or indirectly by linking the data, through the use of identification elements such as his/her name, voice, image, identification number, his/her electronic identifier, his/her geographical location, or by one or more physical, physiological, economic, cultural or social characteristics.

1. Scope and Application

The Notice applies to your use of the Website and all information we collect through the Website Services.

The Notice does not apply to information collected through the App. The collection and processing of information through the App, and any services provided by WeFi through the App, shall be governed by the separate privacy policies, terms and conditions and/or agreements between WeFi and each person who has signed up to use the App (collectively the “User Agreement”).

Where you choose to log in to your App account via the Website, any Personal Data processed in connection with such access will be governed by the User Agreement, in addition to this Notice, as applicable.

It is important that you read the Notice, together with the Website Terms, User Agreement (as applicable) and any fair processing notice we may provide on specific occasions when we are collecting or processing Personal Data about you so that you are fully aware of how and why we are using your Personal Data. The Notice supplements the Website Terms, User Agreement (as applicable) and any other notices we may provide and is not intended to override them.

2. Collection of Information

The Website collects and processes Personal Data in accordance with the DP Law and any other applicable laws, including for specific and lawful purposes explained herein or at the time of collection, or for the performance of a contract we entered with you, or for the protection of your interest.

What kind of Personal Data might we collect about you?

  • Identity: first name, last name, job title and the organisation for which you work. If you are contacting us to exercise your data protection rights, you may provide us with your identification documents. 
  • Contact: email addresses and telephone numbers. 
  • Technical and usage: Browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our Website, and information about how you use our Website. 
  • Marketing and communications: preferences on receiving marketing from us and communication preferences. 
  • Interests and engagement with us: information on our past interactions with you, your interests, preferences and any feedback that you provide directly to us. 
  • Service history: details about services and products you have requested and/or purchased from us.

We do not intentionally request information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership unless required by law or voluntarily provided.

How do we collect information about you?

We collect data from and about you in a number of ways, including:

  • Information you give us: This is personal data you give us by providing information or filling in forms on the Website, or by corresponding with us (for example, by telephone, e-mail or any other digital or electronic form). If you contact us, we will keep at least an electronic record of such correspondence, including personal information shared at that time, in order to reply or process it as per your request. The personal information you give us may include your name, address, e-mail address and phone number, certain device information, username, password, and other information you choose to provide.
  • Information we collect about you and your device: Each time you use the Website we may and often will automatically collect the following information:
  • technical information, including the type of computer, mobile or other device you use, a unique device identifier (for example, mobile network information, your mobile operating system, the type of browser you use, device token, device type, time zone setting);
  • details of your use of the Website, including traffic data, weblogs and other communication data, and the resources that you access;
  • location information where the Website uses GPS technology to determine your current location. If you wish to use certain features, you may be asked to opt-in to your data being used for this purpose.

If you do not wish to share certain data with us or do not want us to use/share it for certain purposes (to the extent possible, in accordance with applicable laws and information in this Notice), you can alter your preferences at any time. Where applicable, please check your device settings for further information about how to do this.

  • Other information we may collect through your use of the Website: When you use the Website, we may collect Personal Data including demographic information, for example information that you submit, or that we collect, which may include age/birth date, location, gender, username, mobile network information, your mobile operating system, the type of browser you use, time zone setting, device location, IP address, SMS data, browsing history information and searching history information.

3. Use of Personal Data

We may use Personal Data which you provide to us or we collect from you to:

  • Provide, maintain, and improve the Website and Website Services, including, for example, to provide products and services you request (and send related information about them), develop new features that will enhance your user experience and our efficiency, provide customer support, and display administrative notifications, whether information-only or required by applicable law;
  • Perform internal regulatory, administrative and operational requirements, including, for example, to prevent fraud or abuse of the Website; to troubleshoot software bugs and operational problems; to conduct permitted data analysis, testing, and research; to ensure WeFi is complying with internal or external legal requirements, including those that necessitate use of digital systems; and to monitor usage and activity trends;
  • Send you communications we think will be of interest to you based on your previous interactions with us; 
  • Notify you about changes to the Notice or Website Services;
  • Allow you to participate in any interactive features of the Website;
  • Keep the Website safe and secure; or
  • Personalize and improve the Website, including to provide or recommend features, content, social connections, referrals, and advertisements, in accordance with your preferences, to the extent permissible by law.

We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your Personal Data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. Please note that we may process your Personal Data without your knowledge or consent, in compliance with the Notice, where this is required or permitted by law.

4. Processing, Storage and Transfer of Personal Data

Processing 

We will take all steps reasonably necessary to ensure your Personal Data is processed fairly and lawfully, in accordance with the DP Law, other applicable laws and the Notice. By submitting your Personal Data, you understand that such transfer, storing or processing in order for WeFi to perform its general administrative functions is necessary and will be done in a proportionate, lawful manner, including but not limited to responding to enquiries you raise via the Website, and maintaining contacts for future informational or promotional activities. Unless otherwise notified, WeFi does not ordinarily rely solely on automated decision-making when processing your Personal Data in connection with the Website.

To preserve the integrity of our databases, to carry out the Website Services, for research, analytics and statistics purposes and to ensure compliance with applicable laws and regulations, we retain Personal Data submitted by you for a reasonable length of time unless otherwise prescribed by applicable law. In some circumstances, we may anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Storage and Transfer of Personal Data

The Personal Data that we collect about you will generally be stored in the United Arab Emirates.

The Personal Data that we collect about you may be transferred to, and stored at, a destination outside of the United Arab Emirates in accordance with the applicable law. By using the Website, you agree that your Personal Data may be transferred to, and stored at, a destination outside of the United Arab Emirates.

Your Personal Data may also be processed by staff operating outside the United Arab Emirates who work for us or for one of our service providers. Such staff may be engaged in, among other things, the operation of the Website and the provision of Website Services.

Depending on the circumstances we may also need to transfer Personal Data to other kinds of third parties outside the United Arab Emirates, for example regulators, government authorities, law enforcement authorities (such as police) as necessary.

5. Sharing of Personal Data

We may share Personal Data which we collect about you as described in the Notice or as described at the time of collection or sharing, including as follows:

Through Our Website Services 

We may share Personal Data:

  • With third parties to provide you with a service that you requested; and
  • With third parties with whom you choose to let us share your Personal Data, for example other apps or websites that integrate with our API or the Website, or those with an API or service with which we integrate.

Other Types of Data Sharing

We may share your Personal Data:

  • With WeFi’s subsidiaries and affiliated entities to the extent permissible by law;
  • With vendors, consultants, marketing and advertising partners, and other service providers who need access to such Personal Data to carry out work on our behalf or to perform a contract we enter into with them;
  • If we otherwise notify you and you provide your affirmative opt-in or consent to share your data, where needed;
  • With third parties in connection with, or during negotiations of, any merger, sale of WeFi’s assets, consolidation or restructuring or acquisition of all or a portion of our business by or into another company; and
  • With third parties in an aggregated and/or anonymized or pseudonymized form that cannot reasonably be used to identify you.

Government Data Sharing

In some circumstances we are legally obliged to share information with public authorities or law enforcement. For example, we may be required to provide information related to a court order or where we must cooperate with supervisory authorities in handling complaints or investigations. In any scenario, we will attempt to satisfy ourselves that we have a lawful basis on which to share the information and document our decision making.

6. Your Preferences and Rights

Marketing and Preferences

WeFi supports your legal rights to opt-in or subsequently opt-out of receiving communications from us. You have the option to ask us not to process your Personal Data for marketing purposes and to remove it from our database, and to not receive future communications. You may change your preferences at any time by emailing us at help@wefi.pro or by using the 'unsubscribe' links which will be contained in the emails we send to you.

Please note that we may continue to send you transactional or service-related e-mails despite your desire to not receive promotional or marketing e-mail messages. Additionally, please note that if you elect to opt-out of or unsubscribe from receiving promotional or other similar e-mails or messaging from our Website, you may continue to receive promotional emails from our other websites, providers, or other non-affiliated marketers whose services you may have accessed via our Website.

Finally, while we may remove your individual contact information from our professional contacts database, please be aware that if such information is in a different, third party's marketing directory through your request or election, you will need to contact such third party directly to request removal.

Your rights

You may have certain rights under the DP law in relation to your Personal Data, including the right to receive information about the Personal Data being processed, the right to request transfer of Personal Data, the right to correction or erasure of Personal Data, the right to object to any decisions resulting from automated processing, the right to restrict or stop Personal Data processing, and the right to object to Personal Data processing.

7. Data Security

WeFi will implement reasonable administrative, technical and organizational measures designed to ensure that your Personal Data is secure on its system. WeFi has staff responsible for maintaining our data protection and security policies, periodically reviewing them and making sure that WeFi employees are aware of our data protection and security practices. Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. As a result, WeFi cannot warrant or guarantee the security of any Personal Data you transmit to us, and you do so at your own risk. To the extent permitted by applicable law, WeFi expressly disclaims any liability that may arise should any third parties obtain the Personal Data you submit through fraud or otherwise where it is no fault of WeFi.

We will notify you and any applicable regulator of a breach where we are legally required to do so. Please contact us at help@wefi.pro immediately if you become aware of any breach of security in connection with the Website.

8. Cookies

Our Website uses web technologies such as cookies to distinguish you from other users of our Website. This helps us to provide you with a good experience when you use our Website. We use the following cookies:

  • Strictly necessary cookies: These are cookies that are required for the operation of our Website. They include, for example, cookies that enable you to log into secure areas of our Website.

  • Analytical/performance cookies: They allow us to recognise and count the number of users and to see how users move around the Website when they are using it. This helps us to improve the way the Website works, for example, by ensuring that users are easily finding what they are looking for.

These links are provided solely as a convenience to you and not as an endorsement by WeFi of the contents of or reliability on such External Sites. You acknowledge that WeFi is not responsible for the availability of or the information and content of any External Site. You should contact the site administrator or webmaster for those External Sites if you have any concerns regarding such links or the content located on such external Sites.

If you decide to access linked third-party websites, you do so at your own risk. WeFi does not accept liability and shall not be liable to you for anything as a result of your acting upon the content of another website to which you may link from the Website.

10. Changes to the Notice

WeFi may change the Notice from time to time and without notice. If we make significant changes in the way we treat your Personal Data, or to the Notice, we will endeavour to provide you notice through the Website or by some other means, such as email. We will publish any amendment or change to this Notice or any part of it on the Website and will specify the date on which such amendment becomes effective. Your continued use of the Website after the stated effective date constitutes your acceptance of the relevant revised Notice, amendment or change. You agree and undertake to review the Notice each time you visit the Website. If you do not agree to the Notice, as updated from time to time, you undertake to cease using the Website immediately.
